Hey guys.. Long story short, basically my girlfriends grandma said she would pay for her books for class this semester. (I have proof in a text message). She paid like $200 of the $700 or so it cost for the books leaving a balance of $500. She says she doesn't have any money to give me and i was pondering about taking her to small claims court for the remainder. She said if i did that she would counter sue me. I have no idea how that is legally possible so i was wondering if you guys had any advice for me about this?
This seems really petty. Why doesn't your girlfriend accept that 200 bucks is better than nothing and raise the remainder of the funds some other way? Presumably she is able bodied and capable of working.
I find it hugely tasteless that someone would sue their own grandparents because they weren't gifted enough money. I sure hope there is more to this than you're saying.
Legally speaking, from the info you have given she has nothing to go on. She CAN try and conter sue but likely the judge will just throw her claim out.
Second, if you do sue her, even with the text you may not win. I'm not exactly sure how it works in texas, but here, if she basically said "hey I'll give you money for your books" (as in a gift/trying to help ya out) thats not really legally binding.
If she said "Paint my deck and I'll give you the 700 for the books" Deck paint service provided and THEN she didn't pay its legally binding. Not sure how it works on a "Gift" type thing though, sounds like she has no obligation to pay other than saying she would.
Not trying to judge here, don't know the family or situation, but seriously, taking your grandmother to court because she only gave you 200 and not 700 is kind of scummy if you ask me. My brother-in-law's mom told him to get a credit card and live off that during college and she would pay it off for him. Racked up 5g limit on the card and she never helped him pay it. Is it kinda s**t, sure, is he suing her over it? No, its his mom...
As far as the texts go I have sued and won with text evidence. I had a case against a crashed vehicle of mine that i have wont with text evidence. This isnt her money this is my money that i used to pay for her books with along with other stuff for her schooling. I know that it doesn't sound good that i am trying to sue a grandma but this is the same stuff that she has done before apparently. That is kind of why I am thinking about perusing this, because she has done this before and gets away with it. Unacceptable by me. I don't care who it is. I've always paid people money that i owed them no matter what the situation. The text that i have says that if i pay for the books for her, she will repay me in payments.
If holding her responisible is the point of this, the text will probably work. I would probably do this though \/ \/ \/ \/ \/

I do find it funny that with all these people on here who are so self righteous and will flame you if you spell K&N as knn, not too many want to tackle granny for backing out and basically stealing this guys money. With that being said, If it were my granny, I would tell you if you sue her we are done. I will work the debt off some other way.

to clarify, I wasn't calling you self-righteous, or anyone specific that made a comment for that matter. I was saying how I would have thought there were a plethora of comments about "take her to court" and "stick it to her for screwing you". I find that internet forum crowds always those very vocal, often self-righteous individuals because they can hide behind the internet. If you are not perfect, you get roasted. I have seen people get flamed for the smallest mistake or indiscretion. I was simply stating that I thought it would be a worse reaction. She is legally in the wrong. Not that I care if he takes her to court; my opinion was to chalk it up as an L and move on.
Imagine if haloevo had popped up here asking the same question. He would have gotten flamed.
