I let a person borrow about $760 for a repair on a car. He has payed me back all of it except $200. This happened back in 2007. I tried to collect the money from him and hadnt had any luck. I was thinking about taking it to small claims court. I was wondering how much of a chance i have with my case in there? The only evidence i have is a invoice of the work done and his name and car info on it. Ive had previous experience with small claims court before and know the general idea of the system. Any info would be appreciated. Btw i live in Texas if that helps any.

my state has a threshold of 2 years, so might be too late to even try. BUT just call your small claims court house to find out wether or not you can even file a claim this late in the game.

did you have a receipt written out upon the loan of the money? If you do, and kept records of the payments, i'd go to court.

Yea i got most of my money back i just wanted to see what i could do about the rest... Its not that big of a deal... Its like $79 around here to file a court claim... I really doubt the guy would even show up for court if i did a claim against him but im just exploring the idea.. Any no i dont have a written agreement saying he will pay me back or any records of that.

If you has something in writing it would probably help your case much more. If theres money owed, theres money owed. Pursue it. Just my opinion.

I can't help you with the legal aspect of things, but I can say with the up front court cost and the time you are going to spend pursuing this, it'll end up costing you more than 200 bucks. Now I'm one that would continue hounding the individual as a matter of principle, but I wouldn't waste my time and effort going trough small claims court for something so trivial.

I feel your pain. I still have one friend who owes me $1,400 and another prick I worked with that owes me a few hundred.

I did have success once with a guy who bought a vehicle from me. He gave me a hard luck story about needing to re-sell the vehicle and sent me a check for the last few hundred.

I sent him the title and the check ended up being from a closed account.

I sent letters to his parents explaining the situation and threatening legal action. I got the money a few days after they got the letters. Smile

Try sending letters explaining the situation to anyone who knows the guy including his family and possibly employer.

He won't want to be labeled a deadbeat to everyone.

I haven't been able to get him to contact me back but i did browse his facebook page and found his mothers page. I sent her a private message with pictures of the invoice of the work on the car attached to the message. I guess ill wait and see if she sends me any response.
